I am writing to urge you to support SB 360, which lowers prescription drug costs for Kansans.
SB 360 is not a pill tax, price fixing, or a handout to local pharmacies. It replaces opaque PBM pricing with transparent reimbursement and establishes guardrails against anti-competitive practices.
You may have heard that “cost-plus” pricing (NADAC plus dispensing fee) will raise the price of low-cost generics from $2 to $12.50. This claim focuses on a narrow slice of low-cost medications and ignores the huge markups PBMs apply to higher-cost medications, where most spending occurs.
Unlike opaque PBM pricing used today, cost-plus pricing creates a clear, auditable standard that limits discriminatory reimbursement and excessive charges at PBM-affiliated pharmacies.
States that have implemented similar PBM reforms report substantial savings:
- Ohio saved $140 million in two years while increasing reimbursement from $0.73 to $9.00 per prescription.
- Kentucky saved $282 million in two years after moving to a cost-plus model.
- West Virginia slowed premium growth by 32.9 percent after PBM reform.
Kansans deserve lower drug costs and a fair, transparent system.
